or the problem was the patch, i mean the diff, not merged with the original source code ?

In which way is the GPL not met?
I am really interested, I don't fully understand the GPL and I don't want to
break it. If the GPL is not met, I'll withdraw all my builds.

Everything related to the source code.

The principle of GPL is to provide sources either directly or by an assembly.
In your case you can supply directly modified sources
or
original sources with modifications, for example : ftp://ftp.pbone.net/mirror/ftp5.gwdg.de ... 14.src.rpm
